Renting offices in Monaco: how much space does your company and team need?

Planning to establish your business in Monaco or move to more suitable offices? Beyond the address and rent, your choice should reflect your company’s legal form, its activity, the number of people working on site and the sanitary facilities.

The floor area stated in a listing does not, by itself, determine how many employees may occupy an office. Here are the points to examine before committing.

SARL, SAM or civil company: different needs

A registered office address must be distinguished from premises actually used by a team. An asset-holding company without employees has different needs from a business receiving clients and employing several people.

SARL: for an exclusive private office in a business centre, the professional sources consulted indicate a minimum of 9 m², increasing with staff numbers. This does not mean 9 m² per employee.

SAM: under the same arrangement, the stated minimum is 25 m², with space adapted to staffing. This threshold alone does not determine occupancy capacity.

Monegasque civil property company: registering an asset-holding company’s address is different from operating offices with staff. No general minimum floor area was identified in the civil-company provisions consulted.

The 9 and 25 m² figures are benchmarks reported by professional sources referring to business-centre conditions. Their application must be confirmed with the Business Development Agency (DDE). They are not a universal scale for all premises in Monaco.

Civil-company legislation provides, among other possibilities, for the registered office to be at a member’s home, the manager’s address or with a domiciliation provider. This does not determine the conditions for accommodating employees.

How much space should you allow for your employees?

The sources consulted do not establish a universal official scale such as ‘two employees = X m², five employees = Y m²’. For a specific project, the relevant authorities should review the floor plan and proposed staffing.

When planning your search, distinguish workstations from meeting, reception, storage and circulation areas. Well-arranged offices may serve your team better than larger premises with substantial unusable space. Allow for planned recruitment too.

Monaco’s general workplace health and safety rules provide, notably, for at least 7 m³ of air per employed person in the enclosed workplaces concerned. This volume must not be confused with 7 m² of floor area and does not, on its own, establish that the premises are approved.

Does the manager count towards the workforce?

A manager who is not an employee is not included in employee headcount. Managing partners of SARLs notably fall under the CAMTI/CARTI schemes for self-employed workers.

Employee headcount must nevertheless be distinguished from the number of people present. Five employees and one non-employee manager means five employees, but potentially six people on site each day. The manager’s exclusion from floor-area or sanitary-facility calculations should not be assumed: it must be confirmed for the applicable rule and the specific circumstances.

When are separate toilets for women and men required?

Article 4 of the Ministerial Order of 14 December 1948 requires separate toilets where staff include both sexes, without specifying a minimum headcount for separation. On a reading of this provision, one male and one female employee are therefore, in principle, sufficient to trigger this requirement.

The text provides for at least one WC and one urinal per 25 men, and one WC per 25 women. An exemption may be granted subject to conditions; it is not automatic for a small business.

Where a non-employee manager is of one sex and all employees are of the other, specific confirmation should be obtained from the Labour Inspectorate.
