What is an SCI in Monaco?

An SCI is a legal structure that allows several individuals, natural or legal, to jointly own and manage one or more real estate properties. In Monaco, the SCI offers specific advantages:

  • Increased confidentiality : Unlike in France, information on the partners of a Monegasque SCI is not accessible to the public, unless officially requested by the competent authorities.

Monaco's tax system is particularly favourable:

  • Absence of income tax : Monegasque residents are not subject to income tax, except for French nationals who remain taxable in France.
  • Reduced inheritance tax : In Monaco, inheritance tax varies from 0% (between parents and children or between spouses) to 16% (between non-relatives), which is significantly lower than the French rates of up to 60%.
  • Optimisation for assets located in France : Thanks to the Franco-Monegasque tax treaty of 1 April 1950, the shares of a Monegasque SCI holding assets in France may, under certain conditions, escape French inheritance tax.

Process of setting up an SCI in Monaco

The creation of an SCI in Monaco involves several steps:

  1. Drafting of the articles of association : Defining the operating rules of the company, they can be drawn up by private signature or by notarial deed.
  2. Tax registration : The articles of association must be registered with the Monegasque Tax Services.
  3. Registration : The SCI is then registered in the Special Directory of Civil Partnerships (RCI) of Monaco.
