Apartments under law 887
While Monaco imposes strict rules on some residential properties, Law No. 887 offers more liberal terms for property owners — ideal for investors seeking control over rental decisions.
No Obligation to Rent or Occupy
Owners are not required to rent or occupy their properties, but must declare any vacancy (Article 2, Law No. 4621). This gives more flexibility than Law 1235.
Free-Market Rent & Adjustments
Landlords can set their own rental prices, and adjust them annually as they see fit — no government control applies here.
Tenant Selection Freedom
Unlike Law 1235, Law 887 allows free selection of tenants among the eligible groups, offering greater autonomy in choosing renters.
Lease Terms & Termination
- Lease term: 6 years
- No automatic renewal
- Terms may be renegotiated freely at renewal
- Tenant may terminate annually with 3 months’ notice
- Landlord may terminate at 6-year mark with 3 months’ notice and no justification needed
Usage Options
Properties can be used for residential, mixed-use, or even liberal professions, making Law 887 attractive for diverse real estate strategies.
Pre-Emption Rights
Similar to Law 1235, the State has priority to buy these properties, followed by the tenant.
Law No. 887 is ideal for investors who value freedom and control in leasing arrangements. It allows strategic pricing and tenant selection — essential for adapting to Monaco’s high-demand rental market.
